SOCIAL UTILITARIANISM AS CREST OF WELFARE STATE: A STUDY

Abstract
In 20th century when start story of the welfare state and lot of activities inherent in the state. The concept of welfare state does not new origin that was rooted theory of social utilitarianism. Social utilitarianism as a jurisprudential concept which as talk about principle of greatest happiness of greatest number, right and wrong principle, aim of law in society and law is result of social struggle etc. According to Jhering, law is a part of human conduct and only instrument for serving the interest and needs of society. I consider this paper relevancy and impact of social utilitarianism on welfare state. The basic point of Justice, equality, security and human dignity how concern welfare state, which was promoting by social utilitarianism. India as a welfare State and a welfare State has lot of duties to ensure the welfare of the citizens; welfare activities involve lot of affirmative action’s like ensuring the dignity of the individual by providing employment, education, standard of living etc. legal system is gate keeper of right and wrong activities of individuals as well as society.
