LEGALITY OF VIRTUAL ARBITRATIONS: AN INDIAN PERSPECTIVE

Abstract Online or virtual arbitration is an emerging trend that is slowly becoming the proffered norm due to the growing globalization and ongoing pandemic. India is also adapting to this change. However, analysis is required as to if Virtual Arbitration are legal under the Indian arbitration regime. Therefore, this article analyses whether the current arbitration regime in India supports virtual arbitrations. The article also suggests the consequent changes that must be undertaken in the legislation to facilitate virtual arbitration in the Indian jurisdiction. |
