CRITICAL ANALYSIS OF THE RELIEFS PROVIDED UNDER THE PROTECTION OF WOMEN FROM DOMESTIC VIOLENCE ACT, 2005

Abstract Women are the foundation stone for the family and society who acts as a transmitter of tradition, culture and morale through generations. With the ongoing evolution of these socio-economic aspects in India, she is subjected to a number of issues in the society irrespective of her age, race, caste, social, economic and political status. Her vulnerability in various forms is the common phenomenon in the Indian society. The silent sufferings of a women in turn makes her an easy prey in the male dominant society. The authoritative, autocratic nature of male member in society and victimization of female does not make the situation better as well. Almost every household in India is suffering from some kind of domestic violence where women either as a daughter, daughter-in-law, or as a wife are abused physically, mentally, verbally and economically. Both men and women are equal in the eyes of Human Rights Law, although women are discriminated time and again, in this patriarchal society resulting it curbing their freedom and rights. Domestic violence being a global issue has reached the national boundaries whilst having its impact on socio-economic, cultural, racial and class distinctions prevalent in our society. This issue has not only gained a wide recognition geographically, but its incidences are also extensive, making it a typical and acceptable behaviour. It is deeply ingrained into our societal norm and has seriously impacted on women’s health and well-being as well in a marital abode. The continuing existence of this violence is morally indefensible and bears a heavy cost individuals’ wellbeing, health systems and the society. |
