COMPARATIVE ANALYSIS OF DOMESTIC VIOLENCE ACT IN INDIA AND USA

Violence against women is globally faced problem, woman’s life is risked not only in public place but also in private space. No society can claim to be free of such violence, the only variation is in the patterns and trends that exist in countries and regions. Domestic Violence is living phenomenon. It is an age-old practice which still prevails in the present day. The perpetrators of domestic violence have often been found to be male and victims their sexual partner. Globally, domestic violence has been recognized as phenomenon leading to the infringement of human rights. Domestic violence is often recognized as the significant barriers of the empowerment of women, with is effects on physical, mental, psychologically and health. It is one of the most pervasive of human rights violations, denying women and girls, equality, security, dignity, self-worth, and their right to enjoy fundamental freedoms at par with men. The Domestic Violence Legislations enacted has proved to be fruitful in protecting the victim and their rights at some length. But it is not the end, this field needs more attention and needs to be worked on to totally eradicate this practice from modern society. The present paper covers the study of Domestic Violence legislations in India and USA, the steps taken by governmental and non-governmental organizations to bring into light this practice. The study reveals the presence of Domestic Violence in women’s life in multidimensional perspective. The study critically analyzes the provisions of the act, what are the major implementation machinery, does proper implementation takes place or not and studies lacuna in the legislations.
