THE ROLE OF THE SUPREME COURT OF INDIA IN DEVELOPING BAIL JURISPRUDENCE

This research paper is intended to study “The Role of the Supreme Court of India in Developing Bail Jurisprudence” as one of the growing needs for an integrated the role of the Supreme Court of India and Developing Bail Jurisprudence aspect as well as Protection of Right to Life and Personal Liberty which is one of the Human Right of everyone.
Protection of Right to Life and Personal Liberty by granting bail is need of every accused person and Under trials. Consequently, it is the duty and liability of every State and Government to protect Life and Personal Liberty of every person. The Constitution of India is fundamental law and which plays very important role in protection of Life and Personal Liberty. It is seen that the Constitution of India contains provisions which require the State and the residents to ensure to the protection of Life and Personal Liberty. A scrutiny of the thought landmark decisions of various High Courts as well as the Supreme Court says about the important role played by the judiciary has opened new aspiration in the Protection of Right to Life and Personal Liberty by granting bail to accused persons and Under trials. Through judiciary activist approach took initiative in development of bail jurisprudence.
This Study deals with a brief study of The Role of the Supreme Court of India in Developing Bail Jurisprudence. The Study has mainly referred to the secondary sources which are available in the form of websites as well as books for the idea of preparing the research work.
