This paper focusses on understanding the word gratuity and its relevance in the employee-employer relations and labour laws, by looking at how the word ‘gratuity’ which means gratuitous payment evolved through the history of trade union movements in England and in India, and how various cases of different tribunals and Supreme Court solidified it as a legitimate claim of the workers and eventually led to the enactment of The Payment of Gratuity Act 1972 . After 50 years of the enactment of the said Act and changing economic conditions of India and world, and with it the employee-employer relations which led the government to enact the new four labour codes to make India a vibrant economy and help in ease of doing business are crucial and relevant. Also, this aims to compare the provisions of Payment of Gratuity Act 1972 and the Code on Social Security 2020 to bring out what has changed, what has stayed the same and what needs to be done more.
