FORUM FOR PEOPLE’S COLLECTIVE EFFORTS V. STATE OF WEST BENGAL: A CASE COMMENT

In this case, the Supreme Court has answered about the constitutionality of state law if it is undermining any central legislation and, in the course, has commented upon the principle of repugnancy which is important in all federal countries as it resolves the dispute between laws made by the centre and the states. The Legislation in question is the West Bengal Housing Industry Regulation Act, 2017 which is contended to be repugnant to the Real Estate (Regulation and Development) Act, 2016.
